DECLARATION OF KAHTIHONTIA:KWENIO [INDIGENOUS WOMEN OF TURTLE ISLAND] THE KAHTIHONTIA:KWENIO DECLARE THAT, AS PROVIDED IN WAMPUM 44 OF THE KAIANEREHOWA, GREAT LAW OF PEACE, THE LINEAL DESCENT OF THE PEOPLE OF THE ROTINONHSONNON:ONWE SHALL RUN IN THE FEMALE LINE. WOMEN ARE THE PROGENITORS OF THE NATION AND ARE THE TRUSTEES OF THE LAND AND THE SOIL FOR THE FUTURE GENERATIONS. NO ONE ELSE HAS THIS AUTHORITY. AS AFFIRMED IN THE TWO ROW WAMPUM AGREEMENT THE INVADERS CANNOT FORCE THEIR WILL ON THE ONKWEHONWE,

REGARDING: THE ILLEGAL OCCUPATION OF ONOWAREGEH OUR INDIGENOUS LAND ON TURTLE ISLAND NORTH, [TURTLE ISLAND BEING NORTH AND SOUTH AMERICA].
WE OBJECT TO THE COLONIAL GOVERNMENTS AND THEIR CORPORATE AGENTS FOR THEIR:
1. Invasion and occupation of Onowaregeh;
2. Their violation of the natural righteousness embodied in the Kianerehkowa, our Great Law of Peace; and their ongoing aggression against us and all that has sustained us for generations;
3. Their violation of international laws; and
4. Their criminalization of the membership of our nations who protect our laws, lands and people, such as Six Nations, Tyendinaga, Yankton of the Republic of Lakota, and too many others to list.
DATE: May 29th, 2008
WHEREAS international law rejects colonial encroachment on and development of our land without consultation with us and our consent; and our perspectives cannot be ignored;
WHEREAS, UN Resolution 1514 affirmed independence of Indigenous Peoples and that colonial practices violate international law. UNTS 1021 condemns the colonial policy of assimilation which is recognized as genocide.
[The Mabo case in Australia];
WHEREAS, the Noongar Aborigines of Australia were affirmed on September 21, 2006, as holding title to Western Australia in Bennell v. State of Western Australia, by proving they continue to exist and are still part of the land.
This confirms our rights as the ethnic trustees of Onowaregeh;
WHEREAS the UN Charter requires that its members cannot use armed force to resolve international differences. U.S. and Canada have done this repeatedly in the past and continue to use this illegal tactic today;
WHEREAS these colonial states have no choice but to respect the equal political rights of the Indigenous People as confirmed in many international treaties including the International Covenant on Civil and Political Rights; and
WHEREAS the United Nations Committee for the Elimination of Racial Discrimination found on March 6, 2006 that the U. S. was
denying the Western Shoshone people their rights to own, develop, control and use their land and resources.
Canada and the U.S. continue to violate the principles affirmed by this and other legal instruments that affirm the illegality of colonialism.
WE, THE Kahtihontia:kwenio, demand an end to the breach of the peace and the continued state of war that are being directed at us.
a) Our governance is based on relations of equality and mutual respect as affirmed by the Kaianerehko:wa. Our relationship with the colonists is based on the Guswentah, the Two Row Wampum. The invaders were never to interfere in our laws, ways economy, social life and our inherent relationship to our land. They would keep their laws and ways and whatever they brought with them from Europe.
b). Colonial states have murdered or removed many of us to exploit our resources.
c). Colonial states refuse to stop their greedy encroachment. Squatters illegally occupy our land, steal our resources and poison our land, water and air almost to a point that life on earth is being put in danger.
d). In 1923 the Six Nations Confederacy of Grand River sent Deskaheh to apply for membership in the League of Nations. He was denied a hearing and his illegal mistreatment set a precedent for colonial states to illegally ignore the sovereignty of Indigenous nations worldwide. We are equals with all other nations in the
world.
e). Their justice system functions to keep the stolen property, to continue the theft and try to oppress us.
WE, THE KAHTIHONTIA:KWENIO, WISH TO PROTECT OUR PHYSICAL INTEGRITY AND OUR LEGAL RIGHTS THROUGH PEACEFUL MEANS, ACCORDINGLY DEMAND THAT:
1.Colonial states obey international laws, uphold freedom, justice and peace including our inherent right of self-determination. They cannot force their laws on us without our fully informed consent and the consensus of the majority of our people. We declare that we will never consented to slavery.
2. Our land belongs to the faces yet unborn. We continue our stewardship so our children will be born free from bondage.
3. We be dealt with on a nation-to-nation basis.
According to international law, no nation can absorb another without our permission. Colonial governments of Canada and the U.S. cannot legally deal with us through their great variety of grand chiefs, band and tribal councils, advocacy groups like the Assembly of First Nations or other private interest agencies that have been forced on us. They are not governments.
4. The rule of law comes from Natural Law which comes from Creation. It encompasses all that is good for humanity, that of being of one mind based on natural righteousness. To create peace we must live in balance with the natural world, according to our own teachings, direction, language and culture. Foreigners cannot legally push their laws on us.
5. Colonial states cannot criminalize us for carrying out our obligations. Our acts have been defensive and peaceful. The current attacks, arrests and false charges on our people for protecting the land are genocide. We demand they remove the criminal records from all of our political prisoners.
6. Colonial agencies commit atrocities by trying to erode and destroy everything that helps us to survive. We wish to maintain the biological and cultural diversity of our ecosystem so that our children and people shall survive in a healthy and democratic environment.
7.Contrary to international law, the colonial states cannot destroy the power of the Kahtihontia:kwenio by trying to illegally impose colonial matrimonial laws on us without our consent. We will never consent to this.
8.Creation put us on Onowaregeh to take care of the land, plants, animals, waters and air. In return Creation takes care of us. We have the natural instinct and will to survive.
WE, THE, KAHTIHONTIA:KWENIO, insist that all our lands, rights and possessions be maintained by us. For 500 years we resisted colonial efforts to kill us and impose their unnatural institutions on us. The colonizers must develop a peaceful relationship with us according to the principles of the Two Row Wampum agreement. They cannot control the lives of the real original people of Onowaregeh. The formula for peace is the Kaianerehko:wa, which was meant for everyone. To develop humanity and sustain life we must all come together as one with our environment.
